Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ShortX ("Company", "we", "us", or "our") concerning your access to and use of the ShortX website (shortx.app), redirect service (shx.it), and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to access the Service.

Service Description

ShortX is a URL intelligence platform that provides:

• URL shortening and management
• Smart redirect rules based on device, location, time, and referrer
• QR code generation and customization
• Click analytics and reporting
• Link organization through workspaces

The Service allows you to create shortened URLs that redirect users to specified destinations. You can configure intelligent routing rules to optimize the user journey based on context.

User Accounts

Account Creation

To use the Service, you must:

• Be at least 13 years old
• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is current and accurate

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users. You may delete your account at any time through the settings page.

Acceptable Use Policy

Permitted Uses

You may use the Service to:

• Create short links for legitimate personal or business purposes
• Share content that you have rights to distribute
• Track analytics for your own links
• Generate QR codes for your destinations

Prohibited Uses

You may NOT use the Service to:

• Illegal Content: Create links to illegal content, including but not limited to pirated content, illegal drugs, or prohibited weapons
• Malware: Distribute viruses, malware, spyware, or any malicious code
• Phishing: Impersonate others or conduct phishing attacks
• Spam: Send unsolicited bulk messages or engage in email spam
• Adult Content: Link to sexually explicit material without proper age verification
• Violence: Promote violence, terrorism, or harm to individuals or groups
• Harassment: Harass, abuse, or threaten others
• Deception: Use misleading or deceptive links (e.g., pretending to be a different site)
• Copyright Infringement: Violate intellectual property rights
• Automated Abuse: Create links through automated means without permission
• Service Abuse: Attempt to bypass rate limits or access restrictions

Link Monitoring and Removal

We reserve the right to review, monitor, and remove any links that violate these Terms. We may disable or delete links without prior notice if they violate our policies or applicable laws.

Intellectual Property Rights

Our Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by ShortX and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain all rights to the URLs and content you submit to the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your URLs solely for the purpose of providing the Service.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use them without any obligation to compensate you.

Subscription Plans and Payment

Pricing Tiers

ShortX offers multiple subscription tiers with different features and usage limits. Current pricing and features are available on our pricing page. We reserve the right to modify pricing with 30 days notice.

Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for recurring subscription fees
• Failed payments may result in service suspension
• You are responsible for all applicable taxes

Free Tier Limitations

Free tier accounts have reduced features and usage limits. We may display attribution on free tier links. Free accounts may be subject to additional restrictions.

Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until the end of the billing period.

Refund Policy

• Annual subscriptions: Refundable within 30 days of initial purchase
• Monthly subscriptions: Refundable within 7 days of initial purchase
• Renewals are not refundable
• Refunds are issued to the original payment method within 5-10 business days

Downgrades

If you downgrade to a lower tier, changes take effect at the end of the current billing period. You may lose access to features and data that exceed the lower tier's limits.

Service Availability and SLA

Service Uptime

While we strive for 99.9% uptime, the Service is provided "as is" and we do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible.

Service Level Agreement (Paid Plans)

• Target Uptime: 99.9% monthly uptime for paid plans
• Redirect Latency: < 150ms (P95) under normal conditions
• Planned Maintenance: Maximum 4 hours per month with 48-hour notice

No Warranty

We provide the Service "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Data Retention

Analytics data retention varies by subscription tier (7-90 days). Account data and links are retained as long as your account is active. Upon account deletion, we permanently remove your data within 30 days, except where required by law.

Data Export

You may export your analytics data and link information at any time through the dashboard or API.

Limitation of Liability

To the maximum extent permitted by law:

• ShortX shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for content accessed through shortened links
• We are not liable for service interruptions, data loss, or security breaches beyond our control
• We do not warrant the accuracy, reliability, or availability of third-party services

Indemnification

You agree to indemnify, defend, and hold harmless ShortX and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Content you link to through the Service

DMCA Copyright Policy

We respect intellectual property rights. If you believe that content accessible through a ShortX link infringes your copyright, please contact us at support@shortx.app with:

• Identification of the copyrighted work
• Identification of the infringing material (the short link URL)
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

We will investigate and remove infringing links in accordance with the Digital Millennium Copyright Act (DMCA).

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which ShortX operates, without regard to conflict of law principles.

Arbitration Agreement

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.

Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action or collective proceeding.

API Usage

If you use our API:

• You must comply with API rate limits and usage policies
• You must not abuse or attempt to circumvent API restrictions
• We may modify or discontinue the API with reasonable notice
• API keys are confidential and must not be shared

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending email notification for significant changes

Your continued use of the Service after changes indicates acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may cancel your account.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShortX regarding the Service and supersede all prior agreements and understandings.
